Jussuf Hoggia Guard of the Seals, and Prime Minister of His Excellency the Bashaw Bey of Tunis. To Mr. Tobias Lear Consul General of the U. States of America near the Regency of Algiers &c. Sir In reply of your letter written me the 22d of the Expiring Month of August, I have the pleasure to tell you, that having taken into consideration the contents of the same, pointing on the demanded, modification or entire change of four Articles of the Treaty of Peace existing between our Regency and the U. States of America, I have given of all an exact account to His Excellency the Bashaw Bey my noble Master and after mature reflections, the same orders me to tell you, that regarding the Article of the Custom houses he promises hereafter & 'till the return of the Ambassador Sidi Soleman Malemelli from America not to Subdue nor make American Subjects such as will come here to traffic in this interval pay any duty more than what other Nations the most favored pay here, and likewise he will not make use of American Vessels that at times might be wanted, in only [2] treating them, how are treated in similar circumstances the Vessels of the most favor'd Nations. In regard to the Salute to be given from these fortresses to the Ships of War of the United States, that at times might come, and regarding to the Flight of the Slaves on board of the said, His Excellence understands leaving [sic] these Articles subsist in the same manner & force of the said Treaty, and not to alter them untill the return of the ambassador with the Ratification of the President and with such additions or modifications that the same will have done to the said Treaty in agreement with the above mentioned President.
